Terms of Use
1. Who We Are
BeThere is a mobile application and related services (collectively, the "Service") provided by BeThere Inc ("BeThere," "we," "us," or "our"). These Terms govern your access to and use of the Service.
2. Eligibility
You must be at least 13 years old to use the Service, or the age of majority in your jurisdiction, whichever is higher. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Your Account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You agree to provide accurate information and keep it up to date.
- We may suspend or terminate accounts that violate these Terms or are used in a way that may cause harm.
4. License and Acceptable Use
Subject to these Terms, BeThere grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use (unless we explicitly agree otherwise).
You agree not to:
- Use the Service in any way that violates applicable law or regulations.
- Harass, threaten, or abuse others, or encourage others to do so.
- Upload or share content that is unlawful, defamatory, obscene, or infringes intellectual property rights.
- Attempt to reverse engineer, decompile, or bypass security or access controls (except where prohibited by law).
- Interfere with or disrupt the Service (e.g., introducing malware, scraping in a way that burdens systems).
- Use automated means to access the Service without our prior written permission, where applicable.
5. User Content
The Service may allow you to submit, post, or otherwise make available content (including text, images, audio, or other materials) ("User Content").
- You retain ownership of your User Content.
- You grant BeThere a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, display, and distribute your User Content solely for the purpose of operating, improving, and providing the Service.
- You represent and warrant that you have all rights necessary to grant this license and that your User Content complies with these Terms.
6. Community Guidelines and Reporting
We may provide tools to report content or users. We may remove content or restrict accounts if we reasonably believe there is a violation of these Terms, our policies, or the law.
7. Third-Party Services
The Service may integrate or link to third-party services (e.g., maps, payment processors, analytics). We do not control and are not responsible for third-party services. Your use of third-party services is governed by their terms and policies.
8. Purchases, Subscriptions, and Billing
BeThere offers paid features, subscriptions, or in-app purchases:
- Prices, billing frequency, and included features will be disclosed at the point of purchase.
- Payments may be processed by a third party (e.g., Apple or Google), and their terms may apply.
- Subscriptions typically renew automatically unless canceled before the renewal date, subject to the applicable app store's rules.
- Refunds are handled according to the app store's refund policies or as required by law.
9. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you agree that we may process your information as described there.
10. Intellectual Property
BeThere and its licensors own the Service, including all software, design, text, graphics, trademarks, and other content (excluding User Content). You may not use our trademarks without our prior written permission.
11. Feedback
If you provide feedback or suggestions, you grant BeThere a perpetual, irrevocable, worldwide, royalty-free license to use it without compensation or obligation to you.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETHERE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any content will be accurate or reliable.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETHERE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETHERE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID BETHERE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.
14. Indemnification
You agree to indemnify and hold harmless BeThere and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.
15. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms or if we must do so to comply with the law or protect the Service or others.
16. Changes to the Service or Terms
We may update the Service and these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, in-app). Continued use of the Service after the effective date of the updated Terms means you accept the changes.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, excluding its conflict of laws principles.
Dispute resolution: Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in English and the seat of arbitration shall be Delaware, United States. You agree to waive any right to participate in class action lawsuits or class-wide arbitration.
18. Apple App Store and Google Play Terms
If you download BeThere from the Apple App Store or Google Play, your use may also be subject to the applicable store's terms. Apple and Google are not responsible for the Service except as required by law.
